Emeriti Philharmonic - international travel with a musical purpose - Cuba March 24-April 8 2017

TERMS AND CONDITIONS

PLEASE READ CAREFULLY 

The following terms and conditions constitute the sole, legally enforceable agreements between Emeriti Philharmonic Cuba tour participants, hereinafter referred to as participants and Daniel Kepl, DBA Emeriti Philharmonic, hereinafter collectively referred to as Emeriti Philharmonic. These terms and conditions are for the Emeriti Philharmonic land package tour of Cuba only, from Friday, June 23 to Wednesday, July 5 2017. Transportation to and from Cuba is entirely the responsibility of each participant. See Trip Details for the latest info on airlines serving Cuba. Each participant shall be responsible for subscribing to cancellation/luggage/assistance repatriation/medical insurance. Click here for a comprehensive list of travel insurers. Emeriti Philharmonic shall not be held responsible in any way for personal injury, instrument damage or loss or any other personal loss, or theft of any kind. 

The number of participants we will be able to accommodate on this unique once in a lifetime 13-day Emeriti Philharmonic musical tour of Cuba from Friday, June 23 to Wednesday, July 5 2017 is limited. Full land package price per person double occupancy is US $2,800 €2,562* GB £2,161* per person, double occupancy. Cancel your trip in writing any time before midnight Pacific Friday, May 26 2017 and receive a full refund except for an administrative fee of US $100 €95* GB £80* per participant. Your payments are deposited directly into a secure Trust Account audited by the California Attorney General's office.

payment schedule

Pay US $2,800 €2,562* GB £2,161* by midnight Pacific Friday, May 26 2017 (price is for double occupancy accommodation). Total land tour price per person for a private room is US $3,780 €3,458* GB £2,919*Pay in full by midnight Pacific Friday, May 26 2017. Cancel your trip in writing any time before midnight Pacific Friday, May 26 2017 and receive a full refund except for a per participant administrative fee of US $100. Your payments  are deposited directly into a special Emeriti Philharmonic Trust Account overseen by the California Attorney General's Office. California consumers are further protected by the Travel Consumer Restitution Fund (TCRC).  Airfare is not included in the land package pricing. Use the payment technology on the web site, which will enable you to access several different credit cards and PayPal services. Currency exchange rates and fees will be applied. Participants may also choose to pay by direct wire transfer, or by check. CANCELLATION, modification PENALTIES & REFUNDS

All cancellations or modifications must be in writing. Any participant waiving for any reason whatsoever, the benefit of services included in the Emeriti Philharmonic land package tour of Cuba from Friday, June 23 to Wednesday, July 5 2017 cannot claim any refund. Emeriti Philharmonic shall not be required to refund any monies to any participant who must leave the Cuba tour prematurely for any reason, nor shall Emeriti Philharmonic be held responsible for any costs, fees, damages, or causes of action which result from the transportation expenses incurred by participants' early departure.   

Participants shall receive a full refund minus an administrative fee of US $100 €95* GB £80* by sending a cancellation/refund request in writing by email before midnight Pacific, Friday, May 26 2017. Thereafter, no refund of any kind will be given.

TRAVEL INSURANCE

Each participant shall be responsible for subscribing to cancellation/luggage/assistance repatriation/medical insurance. Click here for a comprehensive list of travel insurance carriers. Emeriti Philharmonic shall not be held responsible for personal injury or instrument damage, personal loss, or theft during the Cuba tour from Friday, June 23 to Wednesday, July 5 2017. 


ITINERARY CHANGES

Emeriti Philharmonic reserves the right to withdraw or in other ways make changes without notice to the Cuba tour itinerary from Friday, June 23 to Wednesday, July 5 2017 . 


INDEPENDENT CONTRACTORS/LIMIT OF LIABILITY

The participant agrees that Emeriti Philharmonic acts as agent and/or trustee for any person, ground agents and subcontractors, who provide any service forming, or in connection with, any part of the land tour of Cuba from Friday, June 23 to Wednesday, July 5 2017. Intercity transportation services, hotel accommodation, meals, concert venues, and guided tours are performed by independent suppliers who are not employees of Emeriti Philharmonic. In this respect, Emeriti Philharmonic acts only as an agent and shall not be held liable for said services or for the acts or omissions of sub-contractors or other contractors.

Emeriti Philharmonic shall not be held liable for bodily injury to, or death of participants, or for loss of, or damage to luggage or other personal belongings, including musical instruments. Emeriti Philharmonic shall not be liable for failure of an improper performance when the same is due to or caused by the fault of the participant; the unforeseeable or unavoidable fault of a third party unconnected with the provision of any services to be provided; unusual and unforeseeable circumstances beyond the control of Emeriti Philharmonic; an event of Force Majeure such as a war, threat of war, riots, civil commotion, acts of God, terrorist activities, natural and nuclear disaster, fire, technical problems with transport, closure of entry ports, strikes, and any industrial action, or any other event beyond the control of Emeriti Philharmonic.

Prices given at the time of booking are based on economic conditions known on December 10, 2016 and are subject to change. These conditions are, amongst others, the cost of intercity transportation, hotels and meals, relevant dues and taxes (port taxes, embarkation and disembarkation taxes, entrance costs to tourist sites), and currency exchange rates relevant to the pricing of these programs. Emeriti Philharmonic reserves the right within the legal limits of applicable laws to vary prices if necessary. All variation of the cost of transport, taxes, dues and visa costs will be passed on within the land package tour cost. Any changes cannot be imposed less than 30 days prior to the Cuban tour from Friday, June 23 to Wednesday, July 5 2017. 


jurisdiction

These terms and conditions are subject to and interpreted according to International regulations and concern the transportation of Emeriti Philharmonic participants, their luggage and instruments during the land package tour of Cuba from Friday, June 23 to Wednesday, July 5 2017. Emeriti Philharmonic shall incur no liability outside this period of time. Without prejudice to required legal regulations, any actions related either to the interpretation, or execution of this agreement shall be brought before the competent courts of Santa Barbara, California.

Emeriti Philharmonic is not responsible for omissions and/or presentation errors and reserves the right to make corrections as required.
